Medical Records

Tennessee Code Annotated 63-2-101(c)(2).

Under Tennessee law, physicians “own” their patient medical records.  However patients are entitled to copies or summaries of their medical records from a doctor’s office.  We regard the doctor-patient relationship as sacred, requiring trust, mutual respect and confidentiality.  The contents of our medical records remain confidential and will be released only upon your written authorization or in compliance with medical records laws.

Tennessee code annotated defines medical records to include medical histories, records, reports and summaries, diagnoses, prognoses, records of treatment and medication ordered and given, x-ray and radiology interpretations, physical therapy charts and notes, and lab reports.  This statute does not address radiology films.  Original radiology films will not be given, but copies of the film may be released.

A physician is entitled to “reasonable costs” for copying and mailing medical records.  The law provides that reasonable costs are those that do not exceed $20.00 for medical records forty (40) pages in length or less.  For each page over forty, a doctor’s office may charge no more than $0.25 cents per page.  Actual costs for mailing may be charged as well.  A physician’s office has the right under state law to require payment up front for all costs before furnishing the records.
